Scoggins and Scoggins-Gámez handles both uncontested and contested divorces.

An uncontested divorce is one in which both spouses are in complete agreement regarding child custody & support and division of marital assets and debts.

In this type of case, one party hires a lawyer to draft the necessary paperwork. The lawyer can only have an attorney-client relationship with the party that hired him or her and cannot give legal advice to the other party.

Once hired, we will file the petition for divorce. The petition starts the running of the 60-day waiting period that is required in all Texas divorces. The other party signs a waiver of service of process and we then draft a final decree of divorce that reflects the agreement of the parties. Only one party will be required to make a short appearance in court as long as the decree has been signed by both parties.

In a contested divorce, each party hires an attorney and temporary orders are often required.

Temporary orders set the ground rules between the time the divorce is filed and when it is finalized. Temporary orders govern all aspects of the divorce, from who stays in the house and has custody of the children, to what funds can be spent and who will pay the bills.

The parties then begin the discovery process and start negotiating a settlement. If a settlement cannot be reached, the parties go to mediation and then trial if necessary.
